The Company:
Viage, SA, a company registered under number BE 0474 725 225. Registered office: Rue Duquesnoystraat 14 – 1000 Brussels.
Viage is the owner or exclusive holder of the “Package” basic concept, structure, layout and design, an original concept with which you offer a concrete gift. The use of the concept, structure, lay-out and/or design of the gift voucher must have prior written authorisation signed by Viage.
Applicability:
These general sales terms apply to all gift voucher orders issued by Viage and sold on the Viage internet site (www.viage.be) as well as in Viage. By confirming an order for one or more gift vouchers, the client declares acceptance of these General Sales Terms. With each order, he must confirm that he accepts them by ticking a box provided for this purpose. Without this agreement from the client, the order will not be registered. Any nullity of one of the clauses in these General Sales Terms does not result in other clauses being null and void and does not affect the sense of these conditions. Viage reserves the right to modify these terms and conditions at any time by publishing a new version under the internet site heading provided for this purpose. Each order given after publication of the new version of these General Sales conditions will be subject to this new version.
Orders:
All gift vouchers offered by Viage are described in the most detailed and accurate way at www.viage.be, the Viage web site. Orders are made via the internet site, at Viage’s ticket box office, or at the cash desk in the casino until stock runs out. Shortly after ordering your package via the internet site, you will receive a written confirmation by email, fax or mail, this confirmation will also state your order’s reference number. This reference number must be stated on any correspondence connected with the order. When making the order, you must give Viage all the necessary information requested. On request, and provided that you state your company details, we can send you an invoice by mail, at no additional cost. When making an order, should the client provide incorrect or incomplete information, Viage reserves the right to refuse or cancel this order. If the gift voucher ordered is out of stock, we will inform you as quickly as possible and you can then cancel your order. Viage cannot be held liable for any damages which may result from the unavailability of a gift voucher.
Payments:
Orders – whether they are from individuals or companies – must be paid in advance by credit card (Visa and MasterCard) or debit card. The order will be sent to you after receipt of payment. Apart from on site purchase, Viage also accepts payments on its internet site by Visa, MasterCard and debit card. On-line payment by credit card or debit card is carried out through the Paypal security system.
Price and delivery costs:
Viage tries to apply the rates in effect and formally reserves the right to modify its prices and consignment costs at any time, in particular due to indexing or changes in consignment costs, as well as when there are errors in the wording of its rates.
Some gift vouchers have several editions during the year, the price of an edition being able to vary from one to the next.
The client will be informed of the changes in rates in reasonable time and will be entitled, if he wishes, to cancel his order, by sending an email. These rates changes will not apply to orders that have already been confirmed in writing by Viage. The sale of gift vouchers is not subject to VAT. The consignment costs displayed are understood as including VAT and are payable by the purchaser.
The consignment costs for 1 or 2 gift vouchers to a delivery address in the Benelux countries, amount to € 3 incl. VAT (21%).Viage will ensure that the order is delivered within 3 working days, as from the date of the validation of the credit card payment (if order is on a working day before noon). For sending 3 or more gift vouchers, the consignment costs amount to € 6 incl. VAT (21%). It is desirable that someone is present (during office hours) at the delivery address, to take care of receiving it. Viage is not responsible for any delivery delay and cannot therefore guarantee the delivery times, since these are dependent on a third party (carrier). Viage will not be held liable for any loss or any theft which could occur during dispatch or after receipt of the order.
Exchanging a package:
It is possible to exchange the gift vouchers by new versions at the latest 6 months before the end of their validity – so you always have at least 6 months to use your gift voucher. If, by the time it expires, you still have not had a chance to use your gift voucher you will be able to exchange it. The exchange costs in this case (administration, dispatch and printing costs) will amount to 10 Euros (21% VAT included). If you wish to exchange several gift vouchers, the exchange costs will amount to 5 Euros per additional gift voucher (21% VAT included). If you wish to exchange a gift voucher which expired more than 2 months previously, the exchange costs will then amount to 25 Euros (21% VAT included) and 12.5 Euros (21% VAT included) per additional gift voucher. The total amount of exchange costs will be taken into account when calculating the cost of the price of the gift vouchers that you will have chosen in exchange. If the price of the gift voucher chosen is more than the price of the original gift voucher, you will pay us the difference and the exchange costs. You cannot exchange a gift voucher for a lower priced gift voucher; likewise, you cannot exchange several gift vouchers for one gift voucher of higher price via the web site, – these exchanges can only be done at Viage itself. Your gift voucher is finally no longer valid one year after the purchase date.
Consumer rights:
All consumers are entitled to cancel a purchase and be reimbursed their purchase amount with 14 calendar days of its receipt and this without having to provide a reason. This only applies to orders made via the web site (e-commerce), not to purchases made at Viage. In order to implement this right, the consumer must inform Viage in writing and immediately return the gift voucher in the condition in which it was received, at his own risk and cost. On receipt, Viage will refund the returned gift voucher. Viage reserves the right to refuse returned gift vouchers, not to refund them or partially refund them if the packaging is opened or damaged. These conditions do not apply to business clients.
Privacy:
Viage respects privacy rights and will process your personal information with the greatest possible care. Personal information provided will be used to be able to offer you the best service possible, to process your order correctly and possibly, keep you informed on offers and interesting news through our electronic newsletter. Your personal details are not in any way transferred or sold to third parties who are not involved with Viage. You may consult your personal information showing in the Viage file at any time. If you wish to remove this information from Viage’s file, you can inform Viage of this by email or mail.
Liability:
Viage may not be held liable for damages that the client could incur, in the widest sense of the term, unless these damages are the result of gross misconduct or an intentional act on the part of Viage. Viage may not be held liable for misunderstandings, delays, incorrect transfer of orders after using the Internet or any other means of communication used as part of communications between the client and Viage, except if they are the consequence of an intentional act or gross misconduct on the part of Viage.
Suspension of service:
Viage may not be held liable for delivery delays or service interruptions caused by exceptional circumstances (strikes, natural disasters, ...) which make operation of its services impossible. Viage also maintains the right to suspend its service in case of force majeure, an act of God, act of state, and also for technical reasons such as Internet site maintenance. Notification of any possible service interruption will be published on the Internet site.
